Vylos -- Terms of Use Addendum

This Terms of Use Addendum ("Addendum") supplements the CBN Ventures Terms of Use available at cbnventures.io/terms (the "General Terms"). This Addendum applies specifically to the Vylos application ("App"). Where this Addendum is silent, the General Terms govern. In the event of a conflict between this Addendum and the General Terms on matters specific to the App, this Addendum controls.

By downloading, installing, or using Vylos, you agree to both the General Terms and this Addendum.

1. Nature of the App

Vylos is a WireGuard VPN client for Apple platforms, including iOS, macOS, and visionOS. The App configures your device's built-in VPN capabilities using the WireGuard protocol.

Vylos does not provide VPN service. The App does not operate, manage, or maintain VPN servers or network infrastructure of any kind. You must supply your own WireGuard server or configuration. CBN Ventures has no relationship with, control over, or responsibility for any VPN server you connect to through the App.

2. License and Purchase

Vylos is available as a one-time purchase through the Apple App Store. There are no subscriptions, recurring charges, or in-app purchases.

Your use of the App is subject to Apple's Standard Licensed Application End User License Agreement (EULA), unless a custom EULA is provided by CBN Ventures through the App Store. The license granted is non-transferable in accordance with Apple's terms.

3. User Responsibilities

You are solely responsible for:

  • The VPN configurations you import into the App, whether via .conf files, .vylos files, .zip archives, or QR codes.
  • The security, reliability, and legality of any VPN server you connect to through the App.
  • Complying with all applicable laws and regulations regarding VPN usage in your jurisdiction.
  • Ensuring that your use of the App does not facilitate unlawful activity.

CBN Ventures does not review, validate, or endorse any VPN configuration or server that you use with the App.

4. MDM and Managed Configurations

Organizations that deploy Vylos through Mobile Device Management (MDM) may apply managed configuration policies to the App. Supported restriction keys include controls for manual tunnel creation, settings access, and jailbreak detection.

The deploying organization is solely responsible for the configuration policies it applies. CBN Ventures is not responsible for how organizations configure, restrict, or manage the App through MDM.

5. International Use, VPN Legality, and Encryption Compliance

Vylos is available worldwide through the Apple App Store. The legality of VPN use varies by country and region. Some jurisdictions restrict, regulate, or prohibit the use of VPN software. You are solely responsible for determining whether downloading, installing, or using the App is lawful in your jurisdiction. CBN Ventures makes no representation that the App is legal to use in all countries or regions.

The App contains cryptographic functionality. The WireGuard protocol implemented in the App uses modern cryptographic primitives including ChaCha20, Poly1305, Curve25519, and BLAKE2s. Distribution of software containing encryption may be subject to:

  • United States export controls -- Encryption software is controlled under the Export Administration Regulations (EAR), administered by the Bureau of Industry and Security (BIS). The App is distributed through the Apple App Store under the applicable mass-market encryption provisions. You may not download or use the App in violation of US export control laws, including in any US-embargoed country or by any person or entity on a US sanctions list.
  • Local encryption import laws -- Some countries regulate or restrict the import of software containing encryption. You are responsible for complying with any encryption-related laws or regulations applicable in your jurisdiction.

Apple may independently restrict the availability of VPN applications in certain countries or regions in accordance with local laws or Apple's own policies. Such restrictions are outside the control of CBN Ventures.

6. App Protection Features

Vylos offers optional app protection through three methods:

  • System authentication -- Face ID, Touch ID, or device passcode via Apple's LocalAuthentication framework.
  • Managed app configuration -- Organizational access control via MDM.
  • TOTP -- A 6-digit time-based one-time password via an authenticator app.

These features protect access to the App only. They do not provide additional encryption of VPN configurations beyond the protections already provided by the iOS Keychain. CBN Ventures does not guarantee that these protections will prevent unauthorized access under all circumstances.

7. No Warranty Regarding VPN Connectivity

The App facilitates VPN connections but does not operate VPN servers. CBN Ventures makes no representations or warranties regarding:

  • The availability, uptime, or reliability of any third-party VPN server.
  • The speed or performance of any VPN connection.
  • The security or privacy practices of any third-party VPN server operator.

Network conditions, server configurations, firewall rules, and internet service provider policies are outside the control of CBN Ventures.

8. Limitation of Liability

To the fullest extent permitted by applicable law, the total liability of CBN Ventures arising out of or related to your use of the App shall not exceed the amount you paid to purchase the App.

In no event shall CBN Ventures be liable for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to damages for:

  • Loss of data or VPN configurations.
  • VPN connection failures or interruptions.
  • Third-party VPN server issues, including downtime, security breaches, or data exposure.
  • Unauthorized access to configurations stored on your device.
  • Any action taken by a third-party VPN server operator.

This limitation applies regardless of the legal theory on which the claim is based, whether in contract, tort, negligence, strict liability, or otherwise.

9. Governing Law

This Addendum and any disputes arising from or related to the App shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts of competent jurisdiction in the State of New York.

10. Changes to This Addendum

CBN Ventures reserves the right to update or modify this Addendum at any time. Changes are effective upon posting. Your continued use of the App after any changes constitutes acceptance of the revised Addendum. Material changes will be reflected by an updated effective date at the top of this document.
